The Justice Department ended its FCPA enforcement drought by announcing its first corporate settlement in 2022. In a parallel action, the SEC announced its settlement with Stericycle for $28 million for FCPA violations. The SEC’s settlement was second with a company for 2022 (the first was KT Corp.).Under the settlement, Stericycle resolved investigations being conducted by the Department of Justice, the Securities and Exchange Commission, and Brazil. Stericycle agreed to enter into a three-year deferred prosecution agreement and pay more than $84 million. Stericycle will pay $52.5 million in criminal penalties, $28 million to the SEC in civil penalties and disgorgement, and approximately $9.3 million to Brazilian authorities. DOJ agreed to credit up to one-third of the criminal penalty against the company’s fines to Brazilian authorities. Significantly, the DPA requires Stericycle to obtain an independent compliance monitor for a two-year period and then submit a self-report for the rest of the DPA term. Stericycle is a global waste management company which is headquartered in Illinois. In its factual admission, Stericycle admitted a wide-ranging scheme involving the payment of bribes to foreign officials in Brazil, Mexico, and Argentina. In total, Stericycle paid approximately $10.5 million in bribes to foreign officials in Brazil, Mexico, and Argentina to secure business contracts from which Stericycle profited by at least $21.5 million.

Richard Lummis and Tom Fox begin a series on leadership lessons from Theodore Roosevelt. We will look at lessons from Roosevelt’s early years in New York up to his cowboying days in Montana; the second phase of his public career, from NYC Police Commission to Assistant Secretary of the Navy, San Juan Hill and the Vice Presidency; his leadership from his Presidency; his life in the post-Presidency and the election of 1912 and we will end with leadership lessons from his post Bull Moose Party life, World War I and event surrounding his death. In this first episode, we consider the leadership lessons learned by Roosevelt from his parents, his sickly childhood, initial forays into public life, widowhood and cowboying in Montana.

Understanding Lyme Disease was honored in two categories. In this first, the podcast, hosted by Tom Fox and featuring as guests Dr. Ben Locwin and Scott Endicott, was honored with the 2022 Communicator Awards Distinction for Individual Episodes, in this category of Science & Medicine for Podcasts. The second award was in the category of Features for Storytelling. This 5-part special podcast series dealt with those who have been, had a loved one or friend afflicted with Lyme Disease. Endicott is a Lyme Disease sufferer. There are many different ways to go about diagnosing and treating Lyme incorrectly, and very few ways to do it right. In this special podcast series, we uncovered the shortcomings in the current standards and practices and opened up a dialog about how we can better help patients with this disease. I had two passion projects honored as well.
The first was a 5-part podcast series on the Enron Trial of Ken Lay and Jeff Skilling. It was awarded a 2022 Communicator Awards Distinction, for Individual Episodes, in the podcast category of Business. 2021 was the 15th anniversary of the business Trial of the Century. In this series, with my co-host Loren Steffy, who covered the trial gavel to gavel, we explored this portion of the Enron Saga. The Enron trial had everything; massive egos, bigger than life lawyers and a massive fraud. Loren and myself provided our reflections and insights on the first Trial of the Century for the 21st Century and how it still resonates today. The second award was for a passion podcast, The Hill Country Podcast which also received two awards. The first was a 2022 Communicator Awards Distinction for Individual Episodes, in the category of Society & Culture. The second was a 2022 Communicator Awards Distinction in the category of Individual Episodes for Lifestyle. I moved to the Texas Hill Country last year as I have always thought it is one of the most beautiful places on earth. In this podcast, I visit with the people and organizations that make this the most unique areas of Texas. Join me as I explore the people, places and their activities of the Texas Hill Country.
