Welcome to the Sports and Compliance podcast. For the longest time, I have wanted to have a podcast on the intersection of Sports and the World of Compliance and Ethics, both for those stories as they play out on the Sports Page and for the lessons they provide to business executives and compliance professionals. In this podcast series, I am joined by one of the top compliance commentators around, Stephen Martin, CCO at Skillsoft. Together, we will use our love of sports and competition to discuss current ethical issues in sports, look at compliance through a sports lens, and determine how the world of sports and its stories can guide the compliance professional. Trekking Through Compliance: Episode 49 – Return to Tomorrow

In this episode of Trekking Through Compliance, we consider the episode  Return to Tomorrow, which aired on February 9, 1968, and occurred on Star Date 4768.3.

The Enterprise receives a distress call from a planet hundreds of light years too distant to have been visited by any Earth ship. Spock determines that the planet is similar to Earth but older and that its atmosphere was ripped away half a million years ago. Spock detects a power source originating 100 miles below the planet’s surface, and they all beam down.

The landing party discovers evidence of an ancient culture on a planet whose habitable surface was destroyed long ago by a self-inflicted cataclysm. They meet Sargon, who Sargon occupies Kirk’s body. This transference produces great stress on Kirk’s body, causing McCoy to become alarmed. Sargon then asks to borrow the bodies of Spock and Dr. Mullhall so that they may construct androids. Sargon realizes that the temptation for him and Filissa to abuse their god-like powers is too great, and he and Filissa desert their bodies and fade into oblivion.

One Month to More Effective Reporting and Investigations – Investigative Challenges

What are some of the top challenges you may face during an investigation? Beyond the basics, a company must consider the intake process as a starting point, which Jonathan Marks noted is one of the biggest challenges. Rather surprisingly, he noted there are still companies without a hotline or anonymous reporting system, stating “We still see organizations whereby there is no formal ethics hotline except for the fact that they might send an email to some member of management or some member of the Board.”
Planning your investigation, having the right team members involved, and meeting the challenges which inevitably arise during an investigation can be difficult. However, beginning with the DOJ’s 2015 Yates Memo, the 2016 FCPA Pilot Program, and the 2017 and 2019 versions of Evaluation of Corporate Compliance Programs, together with the 2020 Update, 2023 ECCP, and FCPA Corporate Enforcement Policy, the pressure on every CCO and company to get an investigation done quickly, efficiently and, most importantly, right is even greater now. Marks has laid out a concrete way for you to think through how to plan an investigation, staff it correctly, and meet the inevitable challenges.

Gumption is an old word that was used a great deal in the 16th, 17th, 18th, and early 20th centuries. It is the thing that gets you started, your desire, creativity, and what gets you up in the morning. A person of gumption has an intentional life with actions that are success-oriented, positive, and intentional.

We can look to some great historical figures for examples of grit. Michelangelo left many sculptures unfinished because of his gumption and desire to start new projects. He took commissions to do things he had never done, such as the sculpture of David. Walt Disney saw Disney World in his imagination before it was built.

Recently, Tom Fox and Kenneth O’Neal had a conversation about the importance of gumption and creating a strong and supportive community. Tom Fox discussed the importance of finding out who people are, looking at their well-being, and seeing what they want to do out of life. Kenneth O’Neal mentioned that they would link to Tom Fox’s website and the Circle of Gumption book in their show Notes. Tom Fox expressed his enjoyment of being part of the conversation.

Gumption is something that needs to be worked on and matured. It’s the thing that gets us started, and it’s up to us to take it from there. The best way to get to success is to replace bad habits with good habits. People who use their gumption never quit, they get involved and look for the good.

The community can be found in many places, such as Kerrville, Texas, Rotary Club, and Toastmasters. Three major things to do in the community are to set the environment, give hope and encouragement, and hold people accountable. Leaders in the community should provide support, encouragement, and accountability. The goal of the community is to treat everyone well and help them succeed.

Kenneth suggests that creating a community in a business environment is possible by having a leader who cares for other people and is concerned about what they want to do. The leader should create an atmosphere of community impact by having continuous conversations with the team. Effective communication is key to creating a successful community, and this includes support, encouragement, and accountability.

Creating a legacy is an important part of a well-lived life, and this can be done through intentional activities such as family reunions, date nights, and leaving notes for children. To help people create a strong and supportive community in their own lives, Tom Fox and Kenneth O’Neal suggest resources such as books, seminars, and local community organizations.

Gumption is the key to success and creating a strong and supportive community. It’s up to you to have the courage to take the first step and make the most of the opportunities that come your way. With the right support, encouragement, and accountability, you can create a legacy that will last for generations.
